Section 44 of the banking act authorises the German Federal Financial Supervisory Authority (BaFin) to demand access to financial data of institutions, suppliers of sub-services, financial holding associations as well as pooled businesses, which are added to the supervision. The appointed auditor then investigates the business on the financial statements as well as the contractual conditions, which the business is obliged to achieve.
